By creating an account on Hoply you agree to these Terms. This is a placeholder; please review with counsel before going live.
1. Service
Hoply provides a SaaS platform for customer messaging, AI assistance and helpdesk workflows. We offer the service "as is" with reasonable best-effort availability (target: 99.9% uptime).
2. Your account
- You must be at least 16 years old (or the digital age of consent in your country) to use Hoply.
- You are responsible for safeguarding your credentials.
- You may not share a single account between multiple users — invite teammates instead.
3. Acceptable use
You agree not to use Hoply to:
- Send spam, phishing or any unlawful content.
- Distribute malware or attempt to disrupt the service.
- Resell the service in violation of our white-label addendum.
- Train large language models on data harvested through Hoply without consent.
4. Billing
- Paid plans are billed in advance, monthly or yearly.
- You can cancel any time from your account; access continues until the end of the period.
- 14-day money-back guarantee on first purchase, no questions asked.
- Failed payments will trigger a 7-day grace period before account suspension.
5. Data ownership
You own all the data you and your customers send through Hoply. We act as a data processor on your behalf. We will never sell, license or use your data for advertising.
6. Third-party AI
When you opt-in to AI features, your messages are sent to the AI provider you chose (OpenAI, Google, etc.). Those providers have their own terms; you agree to them by enabling the integration.
7. Termination
We may suspend or terminate accounts that breach these Terms. You will receive a notice and a chance to fix the issue when reasonably possible. After termination, we delete your data within 60 days, except where law requires longer retention (e.g. invoices for 10 years).
8. Liability
To the maximum extent permitted by law, Hoply's aggregate liability is capped at the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental or consequential damages.
9. Changes
We may revise these Terms. We will notify registered users by email at least 30 days before material changes. Continued use after the effective date constitutes acceptance.
10. Governing law
These Terms are governed by the laws of Spain. Any dispute will be brought before the competent courts of Madrid, unless mandatory consumer law dictates otherwise.
